第一百一十四条 有下列情形之一的，在公安机关作出治安管理处罚决定之前，应当由从事治安管理处罚决定法制审核的人员进行法制审核；未经法制审核或者审核未通过的，不得作出决定：
第七十四条 依法被关押的违法行为人脱逃的，处十日以上十五日以下拘留；情节较轻的，处五日以上十日以下拘留。
